Abstract (EN)

In Today's global world, by increasing the trade, it is unavoidable to improve one of the most important issue of the commerce, ?the carriage?. In addition to this truth, both parties, (one side is sender and the other side is receiver) who do business, want to feel in confidence concerning their goods during the carriage. Because of this, today especially the long distance carriages are generally performed by more than one carrier. The carriage that is performed by more than one carrier is of great difference in the dispute of which carrier is liable in the carriage and at which rate and against which carriers should the cargo interests claim for the compensation of their derogation and finally in which circumstances the carrier who pays compensation to the cargo interests recourse to the other carriers in the event of loss, damage and delay, according to type of the carriage. One type of this carriage that is main subject of my thesis is successive carriage. It is very well known type among the sender, receiver and international road carriers. Moreover, in practice the other types of carriages especially the sub carriages are also common in commerce area. The clearest feature that aparts the successive carrier from the sub carrier is acceptance of the goods and CMR consignment note of the all carriers that attend the carriage. By this way all of the carriers become the part of the whole transport and liable from whole carriage. The issue I try to explain above is examined detailed in the thesis and provisions of CMR are compared with the provisions of Turkish Commerce Code and Project of Turkish Commerce Code.
