Abstract (EN)
Main objective of implemention of separation remedies in electronic communication sector is to prevent competition problems such as denial to access, discrimination, cross subsidies, which resulted from the vertically integrated firms in the course of new entries in liberalization process. Separation Remedies are basically classified as accounting separation remedy, legal separation and structural separation. However, this distinction can be differentiated according to countries market structure. Separation remedies which applied to prevent specific competition problems in electronic communiation markets have changed dramatically over the past ten years according to the kind of competition problems which are aimed to prevent by. On the process of Turk Telekom privatization, after the Competition Board non-binding opinion before the tender, in tender document it was stipulted structural separation of Turksat AŞ which operates Cable TV Infrastructre in Turkey and legal sepration of TTNet which is the retail arm of Turk Telekom boradband operation. However it can be difficult to solve jurisdiction problems when there will be a need for changing separation remedies which was stipulated in tender documents. In respect of competition and regulation law this study adresses separation remedies in electronic communication sector, jurisdiction among the public bodies while decision proccess of separation remedies and separation remedy which stipulated in the course of Turk Telekom privatization.
