Abstract (EN)

Deficient work, although not clearly stated in Turkish Law, is defined in the doctirne as not doing some of the work that is agreed in the contract or that must be done in accordance with the integrity rule. In our study; After examining the contract of work and the contractor's debts, the concept of incomplete performance, comparison with similar concepts, the issue of whether the missing work can be delivered, the provisions that will be subject to deficiencies in case of deficient work, the rights of the employer in cases where the delivery is made despite deficient work have been examined; Issues such as controversial cases in terms of the concept of underperformance were examined in the light of controversial opinions in the doctrine, legal regulations, examples in practice and judicial decisions. Due to the fact that the concept of deficient work is often confused with defective performance in judicial decisions, some criteria have been introduced. The aim of our study is to concretize the concept of deficient work according to the provisions applied within the framework of judicial decisions.
