Abstract (EN)

Entered into force in 1952 and amended several times afterwards, the Law no 5846 on Intellectual and Artistic Works both regulates and protects the economic and moral rights of owners of works that show a sign of their creator a while stating that "economic and moral interests of owners of intellectual and artistic works shall be protected under this Act", the Act expressly provides legal protection for the moral rights (Arts.14-17), as well as the economic rights (Arts.20-25) of an owner of a work. This thesis focuses on the concept of "work" as regulated in the Law no 5846 on Intellectual and Artistic Works, elements and types of works, ownership of a work, economic rights and finally legal protection in case of the infringement of economic rights. The aim of this thesis is to examine, in the light of court decisions and the literature, problems that may exist with regard to the main elements of works and ownership of works, economic rights of owners of intellectual and artistic works, conditions for benefitting from economic rights, the effects of infringement economic rights and the procedure for different types of legal action that can be brought against the infringement of economic rights, and finally the relevant legal remedies and sanctions for infringement of such rights.
