Ziyade ala'n-nass in the method of Fukuhâ and Mutekellimin and its effect on furu' fıkh

This study aims to examine the concepts of "Ziyade ala'n-nas" and the "Effects of Furu Fiqh" in the field of Islamic law in-depth, according to the methods of the Fukahâ and Mütekellimin. The thesis consists of three chapters, with each chapter focusing on a specific topic to contribute to the understanding of these concepts. In the first chapter, the issue of abrogation (naskh) is discussed, exploring what this significant legal principle means according to the schools of Fukahâ and Mütekellimin, as well as its historical development and place in legal practices. The reason for examining abrogation in this study is that the usul scholars address the matter of "Ziyade ala'n-nas" within the context of abrogation; thus, the aim is to better understand the concept of ziyade. In the second chapter, the issue of Ziyade ala'n-nas is examined in depth through the opinions of the scholars of usul. In this chapter, the approaches of the Fukahâ and Mütekellimin schools towards this topic and the differences between them are highlighted to provide the reader with a rich perspective. Finally, in the third chapter, the effects of ziyade on furu fikh are analyzed. In this context, the impacts of the concept of ziyade on legal practices, its reflections in the fiqh literature, and its legal consequences are examined to shed light on the practical dimension of the topic.
