The protection of genetic data and genetic discrimination

Genetic data obtained as a result of gene analysis are special personal data and is closely related to personal rights. The risk of discrimination based on genetic reasons indicates the importance of protecting genetic data. Because of this reason, it is needed to be proved of the content of the genetic data and distinctive characteristics. In this study, by explaining the gene analysis, the genetic data and the extent of genetic discrimination, it is tried to be explained how to conserve the genetic data in national and international legislation and the cases are included where genetic discrimination can be encountered. Genetic discrimination will lead to the emergence of responsibility against various branches of law. In this study, the legal, criminal and administrative responsibilities that may arise due to genetic discrimination are discussed and the responsibility is examined that cab be emerged within the scope of The Personal Data Protection Law with Human Rights and Equality Institution of Turkey Law.
