Abstract (EN)

İİİ ABSTRACT THE CRIMES OF NEGLIGENCE AND ABUSE OF DUTY (The Turkish Criminal Code Section 230, 240) Nazmiye ÖZENBAŞ Department of Public Law Anadolu University, Institute of Social Sciences, June 2004 Supervisor: Prof. Dr. Nevzat TOROSLU The administrative state is a unifier and sovereign institution which guarantees social trust and order completes individual activities and presents public services in order to provide prosperity, protection and development of society. The state carries out its activities with its organs and these organs are formed by real persons. These persons which carry out the activities of the administrative state can be divided into various groups. One of these groups is formed by the public servants. In that case good administration of the state depends on the public servants, carrying out his duties according to the statutes regulations. When the public servant does not carry out his duty in reasonable time and abuses his duty, he prevents regular and effective working of the administrative state. For this reason negligence and abuse of duty by the public servant are established as crimes in the Turkish Criminal Code. Under the Turkish Criminal Code and other specific laws, negligence and abuse of duty by the public servants have been prescribed as special types of crimes. However the legislature has by no means wished to allow the crimes of negligence and abuse of duty by public servants go unpunished, due to the great loss it causes to the administrative state. Therefore in the sections 230 and 240 of the Turkish Criminal Code, these crimes have been prescribed as general and supplementary provisions when specific provisions can not be applied.
