Abstract (EN)
The freedom to seek justice is an extremely important right that is the guarantee and assurance of all rights included in the Constitution. Therefore, this right must be defined comprehensively and protected against all organs of the state, especially political authorities. However, it should not be forgotten that it is not possible for people to exercise their rights in an unlimited, unregistered and absolute manner. Because in such a situation, conflict of rights will be inevitable. As a matter of fact, the freedom to seek justice is not a right that can be used unlimitedly and must be limited under certain conditions. Therefore, in terms of administrative jurisdiction law, the right to file a lawsuit in administrative courts is a right that can only be exercised within certain legal periods. The length of the lawsuit filing period in question can only be determined by ensuring the delicate balance between the stability of the administration and the freedom of individuals to seek their rights. As a matter of fact, the main purpose of our study is to contribute, at least to some extent, to achieving this balance. In this context, our study was carried out under two separate headings. In the first part, the freedom to seek justice is discussed under various headings and examined in detail, and the litigation procedures in the IYUK are systematically evaluated along with doctrinal discussions. In the second part, various evaluations were made regarding the limitation of the right to file a lawsuit in administrative jurisdiction for certain periods of time and the conditions required for limiting the freedom to seek justice in accordance with the Constitution in the context of Article 13 of the Constitution were expressed in detail.
