Abstract (EN)

Humanity has been undergoing continuous change and development, and with the spread of the population across the globe and its constant growth over the millennia, there have been developments and diversifications in the ways in which land has been used. Consequently, the necessity to oversee this critical asset has become paramount. The field of real estate management is segmented into two distinct categories: the management of real estate owned by the state and the management of real estate owned by private individuals. The Public Real Property Immovables location serves as the primary hub for the majority of public services rendered to the general public. Furthermore, the revenue generated from Public Real Property Immovables with residential, commercial, tourism, and other development characteristics contributes millions of liras to the national budget on an annual basis. In light of the aforementioned considerations, Public Real Property Immovables assets have emerged as a critical lifeline for the nation. In light of these circumstances, the effective management of this asset assumes paramount importance. The management of these properties is examined based on various criteria, and among these criteria, the most important is undoubtedly the master urban planning schemes. The formulation of urban plans is of paramount importance, as they dictate the future course of all transactions and processes involving public real property immovables. Consequently, the implementation of master urban plans on public real property immovables exerts a direct influence on the fulfilment of public needs and the national economy. Furthermore, modifications to master urban plans concerning Public Real Property Immovables are implemented in response to the evolving and changing needs of the community. These procedures are executed in accordance with emergent public needs and upon request; however, they can also be carried out ex officio by municipalities. However, in practice, there are significant uncertainties and unresolved issues. Consequently, public losses ensue. Administrative procedures grounded in the principle of public interest have the potential to result in public losses when implemented in accordance with the prevailing legislation. This issue gives rise to a conflict of public interest. In this thesis, the application of the current legislation, workflow diagrams, and concrete examples are explained in detail, and the points at which public harm occurs are identified. In light of the identified public harm, revised approaches to the current legislation have been proposed as a remedial measure. The aforementioned revisions have been implemented to remodel the procedures and processes to be followed, with the objective of preventing the public harm.
