Abstract (EN)

This study is a research work that examines Fiqh Works in the Indian Subcontinent. Islamic law constitutes a distinct branch of Islamic sciences called Fiqh and is intricately connected to both the Quran and the Sunnah of Prophet Muhammad (pbuh), encompassing a broad spectrum of human life. At the same time, Fiqh is related to Allah and human beings. For these reasons, Islamic law has been applied for over a thousand years in large parts of Asia, Europe, and Africa. It has adapted to changing social and economic conditions by interacting with different cultures and regions. This situation has heightened the interest of thinkers in the Muslim world in Islamic law from the very beginning. With the influence of Islamic sciences in the Indian Subcontinent, there was initially an emphasis on the science of Hadith, particularly in Sindh and Gujarat regions. However, later scholars also turned their attention to Islamic Law. During this period, notable works emerged such as Al-Fatāwā al-Tatarkhaniyya, Al-Fatāwā al-Hindiyya, and Sinwan-ul-Qadā Wa Unwānu'l-Ifta. Additionally, compilations on Usūl al-fiqh like Musallamu's-Subūt and its commentary Fawātīhu'r-Rahamūt, as well as Nurul-Anwar (Principles of Islamic jurisprudence), have garnered significant attention. Some of these works can be considered as the Encyclopedia of Islamic Law. The Muslim world acknowledged the contributions of jurists in the Indian Subcontinent, and pivotal studies on Islamic law were conducted in both Urdu and Arabic languages. This enthusiasm is clearly reflected in Muhammad Ishāq Bhattī's Urdu book Fuqahā-e-Hind (Biographical dictionary of noted South Asian Scholars of Islamic jurisprudence). The special interest of jurists and scholars in the Indian Subcontinent in Islamic law necessitated research in Türkey to understand the position of science during this period. This master's thesis is a vital step toward fulfilling this scholarly need. This study, conducted using the qualitative research method, focuses on examining post-1857 fiqh strenuousness in the Indian Subcontinent within the field of Islamic law. Additionally, it aims to introduce Islamic jurists and present their approaches. Key Words: Fiqh, Islamic Law, History of Islamic Law, Indian Subcontinent, Islamic Jurist in the Indian Subcontinent.
