Abstract (EN)
The institution of suspension of pronouncement of the judgment entered into Turkish law for the first time, applicable only for accused juveniles in the Code for Protection of Children in 2005; it became applicable to accused adults after the amendment of the Code of Criminal Procedure in 2006. Although the suspension of pronouncement of the judgment is a very young institution, it is applied very frequently and discussions on its implementation continue in the doctrine and judicial decisions. In this study, we aimed to examine the position, application and effects of the suspension of pronouncement of judgment in the entire system of law, including criminal law and other branches of law with the thought that the system of law is integral. At the end of this study, it is revealed that current state of this institution has not been fully integrated into the Turkish law system, which includes criminal law and other branches of law; it is not also compatible not only with the objectives of individualization of criminal responsibility and restorative justice, but also with fundamental principles of criminal procedure law and human rights.
