Abstract (EN)
The Regional Administrative Courts, which carried out the examination of the course of appeal law, became operational on 20 July 2016 throughout the country. The new course of the law of these courts, which have not been in operation since the Republican era and is expected to take effect for a long time, has changed many of the established rules and habits existing in the Turkish legal system. Although the rules regarding the course of law to be applied by the Regional Administrative Courts are regulated in detail in the Code of Civil Procedure, the provisions of the course of appeal law are brought before the special courts in their own laws. Among the special courts, the Enforcement Courts stand out with the quality of their own judgments and decisions. For this reason, the Code of Enforcement and Bankruptcy has brought articles of law peculiar to the Enforcement Courts in the examination of the course of appeal law. Both the newly introduced course of appeal law; as well as the examination of the Enforcement Courts own trials and specific articles brought for the trial of the courts of appeal law, as a whole constitute the main lines of the study. Although the provisions of the Code of Civil Procedure regarding the review of the course of appeal law are newly operate in practice by the Regional Administrative Courts, despite the fact that more than one amendment was made in the articles, our study tried to be explained to the extent that it complies with the decisions of the Enforcement Courts.
