Abstract (EN)
Performer artists are defined as those who play, sing, play, narrate or otherwise interpret a work in an original way with the permission of the author. The place of the performer artists, who are among the rights holders related to the rights of the author, in the Intellectual Law has been determined and the identity of the performing artist has been revealed. Performer artists have moral and financial rights over their performances, provided that they do not harm the rights of the owner of the work. The rights of performing artists are explained within the framework of the legislation and in terms of the possibilities created by rapidly changing and developing technologies and various methods that have emerged. The right to demand a reasonable price, which is not yet included in our legislation, but has started to take place in national and international legislation, which allows performer artists to demand an appropriate price from the high profit obtained from their performances after transferring their financial rights, is also included in our work as an expected right. The transfer of financial rights and the rules regulated in the legislation regarding the transfer of the right to use and the subject of inheritance of both financial and moral rights are also included in our study. At this point, the issues of authorization of professional associations and collective rights management in terms of rights follow-up are also mentioned.
