Abstract (EN)

In construction contracts, the contractor undertakes to build a building or residence, which bears the quality of a work of art, and the employer undertakes to pay compensation for this work. The concept of time period is important in construction contracts. Just as contractors are obliged to deliver the construction project within the time period specified in the contract, employers must also fulfil their own obligations in order for the contractors to comply with the projected time period. In the event that an employer fails to fulfil their obligations in order for the construction to be completed within the time period specified in the contract, or other reasons emerge justifying an extension of time, the contractor should be granted the right of time extension. Granting a time extension will allow the contractor to avoid falling into default, and fulfil their obligations within the extended time period. This study will describe construction contracts, the rights and obligations of the parties and the legal nature of such contracts in general, and then discuss the concepts of time period and project delivery. In this context, we will try to explain the terms and conditions of a time extension, and the cases that would justify granting one. After discussing the consequences of time extensions, we will discuss the FIDIC International Construction Contracts used in many countries including Turkey within the general framework, and in this context, examine the time extension and dispute resolution methods in contracts under the FIDIC Red Book.
