Abstract (EN)

The political assembly realizing the auditing acts upon the ideas and aims of the political parties that control the Jurisdiction and Legislation assemblies. Political auditing is not contented with only auditing the legal aspects, it also audits the political aspects located around it, and thenIt audits the effects which are emerged regarding both conformity and constitutionality.The secondary legislationmay be more successful for the countries that do not clearly determined the Judicial Review of the laws? constitutionality in a text.The laws? constitutionality in the countries which have been constituted upon the laws plays two important roles. On the one hand it enters into state formation as a base element; on the other hand it plays an active role in order to protect the validity of the states? laws and its sovereignty.A High Court has not been formed in Iraq in order to control the constitutionality auditing of the constitutional laws and to investigate the decisions, regulations, and orders that have been made upon these laws and introduced by Execution and Legislation Assemblies if they are in conformity with the constitution ?the constitution prepared in 1925 ever since the foundation of Iraq State.The Iraq State Constant Constitution prepared in 2005 differs by the Iraq State Transition Period Administration Law in way of founding a High Court, selection of president and members, and the methods to be used in the constitutionality auditing.In our study in the boundaries of a master thesis, the location and superiority of the constitutions in the legal order of Iraq, the auditing methods of the laws regarding constitutionality, and the compliance audit of the laws regarding the constitution have been tried to explain.Key words1.Iraq2.The Constitution3.The auditing of the Constitution4.The Superiority of the Constitution5.High Federal Court
