Abstract (EN)

The establishment of ethical principles for the judiciary has been a fundamental priority throughout the history of legal systems worldwide. These principles aim insurethat judicial processes are conducted fairly, impartially, and effectively, thereby maintaining public trust in the justice system. In Islamic law, justice has been accorded significant importance, and moral behavioral standards for judges have been established. According to these standards, judges are expected to possess and be perceived by the community as having qualities such as expertise, impartiality, independence, fairness, honesty, and reliability. The principles related to judiciary in Islam have been in practice since the time of Prophet Muhammad, evolving over time and eventually formalizing into written legal documents, thereby acquiring an official status as rules to be followed by judicial authorities. In this study, we present a comparative analysis of the principles of judicial ethics emphasized in historical documents with those accepted in contemporary international conventions. This comparison offers a critical perspective within a historical and cultural context, highlighting the interaction of the modern legal world with universal values.
