The function and sustainability problems of marriage contract in Islamic Law

This study consists of an introduction and three chapters. Examining the mission that Islam has placed on nuptials and therefore on the institution of marriage at the point of procedure, and then determining the problems affecting the sustainability of marriage in connection with this mission constitute aim of our study. This finding, just like diagnosing a disease, aims to shed light on the problems that prevent the nuptials establishment that was built independently of the principles presented by Islam. In the introduction, the importance and purpose of the subject, the scope and method of the study are given. In the first chapter, the meaning of the marriage according to Islamic law, its influence, how it occurs, what are the conditions required for the establishment and their types are examined. In the second part, it is tried to explain what kind of function that marriage has for "human" and "society. In the third chapter, first of all, the matters that Islam puts forward and which Muslim people are expected to live according to this order are explained in order to carry out the marriage institution in the healthiest way since it has a living structure. Then, the problems faced by individuals who are partially or wholly get distant from having an Islamic quality in terms of being able to maintain their nuptials institutions are examined and the existences of the solutions in Islamic law are tried to be revealed.
