Abstract (EN)

Achieving social justice is a great legal purpose that State has a role in. Islamic Fiqh has shown this role, so this role and this Fiqh should be highlighted to control the path, correct the performance and contribute to achieving dreams of the peoples. In the provisions of Islamic Shari'a, is there anything which achieves social justice? Does State have a role shown and framed by the Islamic Fiqh? Can these provisions represent a comprehensive applicable theory? The importance of the research is reflected in meeting the urgent needs of peoples through Islamic provisions which we worship Allah by applying them. It is also reflected in showing that Islam is able to provide solutions to this dilemma which has puzzled mankind in every time and place. 1- To reflect the means of achieving social justice in Islamic Shari'a. 2- To show the role of State regulated by Islamic Fiqh in achieving social justice. 3- To contribute to providing legal solutions to one of the big social problems. The researcher will follow more than one method such as inductive method which aims at investigating the streams of social justiceand the roles of State in achieving it.Besides, the researcher willalso follow deduction and analysis to come up with an integrated theory in this regard. This research is divided into three chapters other than the introduction, preface and conclusion. The first chapter discusses the role of State in Zakat and taxes and Awqaf. The second highlights the role of State in controlling and protecting markets. The third discusses equity and the role of Muslim State Treasury (Baitul Mal). 1-Islamic States should seek to achieve social justice through its streams in Islamic Fiqh as much as possible. 2-Peoples' dream in establishing social justice cannot come properly true except through Islamic Shari'a. 3-Zakat is one of the greatest streams of social justice and balance of economy is related to markets which have to be reformed. This is a kind of Fiqh which maintains the origin of social justice.
