Abstract (EN)

The thesis named "Ignorance According to Islamic Trade Law and Impact to Current Contracts" contains an introduction and two sections. Introduction part includes subject and scope of the thesis, its importance, aim, method and the methodology to follow, and other works carried out related with this topic. In the first section, the explanation of ignorance is given and concepts like "garar, gabin, galat, kumar and ibhâm" and their relations with ignorance are explained. Hadiths related with unknown in sunnah and legal comments based on these comments are addressed, and parts of ignorance namely little, middle and excessive ignorance are explained and their impacts to the contracts are mentioned. Sections of ignorance as per topic are also handled and contracts harmed or not harmed by ignorance are stated. In the second section, current commercial contracts are assessed according to ignorance feature; application of ignorance to current contracts are addressed; some popular contracts selected and dealt according to ignorance feature and legal conditions stated.
