Abstract (EN)

Turks who lived in Central Asia in the pre-Islamic period have a nomadic lifestyle. The social order is provided by an oral law called custom. Turks, who were accepted the religion of Islam from the eighth century and became Muslim in groups, have lived with Islamic religious rules since then. There are various opinions regarding the Turks being Muslim. There were also those who argued that the reason why Turks are Muslims is that the Turkish tradition is similar to the rules of the Islamic religion, and that the Turkish tradition is not similar to the religion of Islam and that the Turks are forced to Islam. Provisions regarding the family are living and observable rules in every society. By analyzing the family rules of Turkish tradition in the context of Islamic law, the similarities between the two legal conceptions have been revealed. Twelve of these subjects, which were examined under approximately fifteen titles, were found to be similar.
