Abstract (EN)

Public investments have an important role in our national economy. Investments to be made using public resources are realized by central and local governments in accordance with the principles of the Public Procurement Law No. 4734 and the tendering procedures defined in this law. The largest share of public investments in monetary terms belongs to construction works. The financial size of public construction investments attracts the attention of all segments of the public, either as bidders or employees, who are candidate to realize the investments. The realization stages of public investments should be evaluated under two main headings: the pre-tender process and the post-contract process. While the construction work tender is a situation in which only the public personnel in charge are involved during the preparation phase, it turns into a two-partner system as the contractor and the administration after the works are bound by contracts. It is important to examine all the problems experienced, to evaluate the situations caused by the problems, and to gain experience in this direction to ensure that the stakeholder status between the administration and the contractor, which is formed as of the signing of the contract, is maintained with healthy management and correct implementation within the framework of public interests for the sake of showing the due care during the preparation and construction of future investments. Unresolved disputes between the administration and the contractor during the pre-tender process or during the construction of the work, regardless of the source, may cause the completion of the investment to be delayed or left incomplete. The great attention that the construction sector draws brings the desire for fast construction and a decline in the quality standards of manufacturing. This situation gives rise to the inability to make the right design and choice due to the limited time kept during the project design stage of the construction work, and accordingly, to move away from quality manufacturing during construction. In this thesis, the laws, regulations, and institutions related to the realization of public investments are defined, the life cycle of public investments is discussed with the problems encountered in the tender preparation and construction process, and solution proposals are presented by means of an analysis of a sample public investment.
