Abstract (EN)
In this study the carriage of dangereous goods is examined from the perspective of civil responsibility. The carriage of dangereous goods is handled in terms of both national and international carriage. The subject of this study is not carriage of any goods, but the goods which have some certain qualifications as being dangereous. Because of these qualifications, carriage of these goods is substantially critical. Accordingly, the carriage of dangereous goods may be subject to special regulations. In the absence of specific legislation and regulations, the general provisions concerning carriage of goods are applied. The phrase "dangerous goods" is not defined in the relevant legislations, it may be defined as all types of solid, liquid and gaseous objects threatining public safety and order -apart from the carriaged body- and thus the life and physical integrity of human beings and other living beings, environment. Dangerous goods can be solid and liquid and in gaseous form provided that they have certain limitations. The limits for liquids and gases are conserved materials such as cap, bottle, tube, tank and so on. Parties involved in the carriage of dangerous goods are obliged to fulfill obligations under the contract of the carriage of the goods from the receipt to the delivery. In addition, the carrier is liable for main problems of the carriage of dangerous goods such as damage, loss and liability arising from delay. Besides, the carrier of dangerous goods may be responsible for the acts and negligence of other persons. As well as the other carriage types, there are some documents for the carriage of dangerous goods including consigment note, despatch note, accompanying information and documents. These documents provides the evidence and the opportunity of proving to the parties. This issue is evaluated in the third chapter of this study.
