Abstract (EN)
The results of the default of the debtor in contracts that load mutual debt, which are the subject of the study, are regulated between the articles 123-126 of the Turkish Code of Obligations. When this provisions are examined, it will be seen that if the debtor does not perform his essential performance obligation in timely manner, the creditor shall be granted elective rights ecxept the general results of the default. The study consists of the two parts. In the first chapter, the default conditions of debtor in terms are explained. In the second section, the elective rights of creditors arising from the default of the debtor and the other consequences of the default will be emphasized. In this study, the contracts that have a mutual dept burden.
