Abstract (EN)
One way of ensuring people's existence and participation in society, and thus the development of their material and spiritual personalities, is legal transactions. The principle of autonomy of will and the principle of freedom of contract as its extension allows individuals to carry out these legal transactions freely. However, this principle is subject to certain limitations. One of such constaints is an oppressive contract, which reduces legal transactions to a violation of (public) morality by excessive limitation of the personal right on the freedom of economic activity. In our study, the personal right to the freedom of economic activity has been evaluated with various elements peculiar to oppressive contracts. When there is an opinion about excessive limitation and dependence on the other party with these elements, the violation of the public morality and partial or complete invalidity of the relevant legal transaction's provision or provisions are discussed and various solutions are offered.
