Abstract (EN)

The subject of our study is "Protection of Personality". Person is one of the most fundamental legal concepts both in our country's legal system and in foreign legal systems. To explain the concept of a person clearly, it is first necessary to define personality. With the most basic classification, the concept of person is divided into two main categories natural person and legal person, and these concepts are constantly encountered at every stage of our daily lives and in all legal transactions. As a result of this, both national and international sources have attributed great importance to the person, and many regulations have been made to define it, determine its scope, and guarantee it. In our thesis, firstly, the concepts of person and personality are analyzed, and the types of persons, the qualities of personality, and the values within the scope of the right of personality are discussed in detail. Subsequently, national and international sources on the protection of the right of personality are given, and the conditions sought for the violation of the right of personality are written in two categories general conditions and special conditions. In the last part; the judicial remedies that can be applied for the protection of the right of personality under the legislation of our country are explained in order. In our thesis, the opinions in domestic and foreign doctrine are frequently mentioned, controversial points are mentioned and these are tried to be clarified. On the other hand, current judicial decisions are also mentioned and examples and approaches in practice are presented.
