Abstract (EN)
Insurance contracts are contracts that create a permanent debt relationship. In this context, the policyholder is obliged to notify the insurer of various issues from the moment the contract is concluded to its expiration. In this study, the declaration obligation of the insured in life insurance is examined in detail under three main headings: at the time of the conclusion of the contract, during the continuation of the contract and in case the contract is realized. In our study, first of all, general explanations regarding the declaration obligation of the insured, which continues from the establishment of the contract to the realization of the risk, are given in life insurance contracts. In the continuation of our study, detailed information about the declaration obligation of the insured is given and in the last section, the consequences of the insurant's violation of the declaration obligation are explained. While doing this study, the basic principles of life insurance contracts regarding credit in Turkish Law were examined and legal questions encountered in practice were included. In addition, examples of the insured's obligation to declare and judicial decisions are given.
