Abstract (EN)
Loss and loss of negotiable documents is an area that is regulated between 661 and more of the Turkish Commercial Code numbered 6102. In this study, the ways to be followed for the cancellation of the negotiable documents in general, and the different opinions put forth in the doctrine at some points which are not clear in the Law and the points of view of the Supreme Court are discussed. Our study consists of five parts. In the first part, general information about the negotiable documents is given. In the second part, the concept of loss, information on the preventive measures given by the court in case of the loss of the negotiable documents, the cancellation case and the conditions of this case are discussed. In the third part of the negotiation process according to the type of negotiable documents; in the fourth section, the effect of the cancellation decision and the effect on the persons concerned with the bill; in the fifth and last chapter, the conditions of the extradition case and the process of proceedings are emphasized.
