Abstract (EN)
Limited liability companies have an important position in commercial life in our country and are the most widely established type of company. The capital share in limited liability companies is a very important legal institution in terms of both doctrine and practice. For this reason, it is also necessary to determine the legal transactions that the capital share may be subject to. In the 3rd subsection of the 6th division of the Turkish Commercial Code numbered 6102 regarding limited liability companies, the provisions for the transactions involving the capital shares are given. According to these; transfer, pledge and usufruct rights can be established on the basic capital shares, the company shall acquire its own shares and the transfer of the capital shares can be achieved through inheritance, matrimonial property regime and through execution offices. In addition, according to Article 133 of the Turkish Commercial Code, the capital shares may be subject to seizure by the execution offices. In this thesis; firstly the concept and legal nature of the limited liability company capital share has been examined. Then, the main legal transactions that the capital shares are subjected to, including transfer, pledge and seizure are discussed.
