Abstract (EN)
Providing public service is among the duties of the administration. It can be said that one of the reasons for the existence of the administration is a kind of public service. Municipalities, which are within the administrative apparatus in a broad sense, also have public service activities that they are obliged to carry out within the city in accordance with the legislation. Transportation services are among the activities that are legally public services provided by municipalities. Municipalities provide transportation services within the framework of public service, which is one of the important subjects of administrative law theory. Since municipalities carry out their activities within the framework of the principle of legality regulated in Article 123 of the Constitution, they must also provide transportation services for the public benefit in accordance with the legislation. Transportation service must be performed in accordance with the principles of continuity and regularity, adaptation, impartiality and equality. In addition, it is a requirement of the principle of legal administration and the state of law to protect and observe the fundamental rights and freedoms guaranteed in the Constitution during the performance of the service. Providing transportation services in metropolitan cities requires a larger organization, administrative structure and budget. For this reason, UKOME, a unit specialized in transportation, was established by law within the municipality. UKOME is an administrative unit without a legal entity with a broad participation, pluralistic structure in terms of the number and quality of its members. In normal municipalities where UKOME is not in charge, provincial traffic commissions make decisions on transportation-related issues throughout the province. In this context, the development process of the transportation public service in our country from past to present, its features, principles, methods of providing the service, and the institutions in charge are examined. In addition, many legal problems and issues arise while providing transportation services. These will be evaluated within administrative law institutions within the framework of administrative law theory. Since many disputes arise during the execution of transportation services, examining the decisions made by judicial authorities in this field is an extremely important issue in terms of understanding and resolving the issue. Ultimately, transportation is not a field of study that has been discussed in detail in the public service doctrine and works have been produced on its behalf. Transportation services are provided within a huge administrative structure with a large number of vehicles, equipment, personnel and assets allocated by the administration to this service. Today, it is an area that continues to exist in a changing and developing order in almost every country and city in the world.
