Abstract (EN)
Preemptive right was regulated in Paris Treaty. The fourth item of Paris Treaty provide opportunity to owner trademark in order to prevent the loss of a right in the meantime of them between the first application and second application where the other country. In our country, preemptive right was regulated in the number 556 no about protection of trademark in the executive order. Preemptive right is divided two types which is the convension priority and the exhibition priority. The convension right from these rights enlarge trademark rights in point of geographic area and the exhibiton right in point of time period. The purpose of this study isto clarify the preemptive right in terms of the trademark, why preemptive right required, how the application of preemptive right is performed and is to demonstrate that what the provisions.
