Abstract (EN)
Mecelle, which was applied as the text of the law in the Ottoman Empire, has always been one of the main sources of reference both in the period it was applied and in later periods. In our study, we draw attention to Mecelle. In addition, basic principles of the donation, which are encountered in many places in social life, are mentioned.In the first part of this study, the importance of the donation was emphasized. In the next section, the importance and characteristics of Mecelle are mentioned and the donation clauses are given. Finally, in this study, a comparison of the articles in the "Kitabü'l-Hibe",section of Mecelle, and the donation chapters in Mutun-i Erbaa, which are valid texts of the Hanafi sect, is dealt with as a whole.
