Counter claim in Procedural Law

This primary purpose of this study is to discuss 'Counter claim in Procedural Law'. Counter claim is a claim pled against the claintiff by a defendant where defendant is required to make a counterclaim in an answer if the counterclaim arises from the same transaction or occurrence on which the plaintiff is suing. The study consists of three main parts and the first part consists of two sections. The first section, mainly focuses on the the concept of counterclaim and its significance. In the second section, legal conditions of counterclaim are examined in detail. The second part of the study demonstrated the required conditions for counterclaim that are not enacted by law. These conditions are further explained through the instrument of supreme court decisions and doctrine. The third part of the study consists of two sections as the first part. The first section of the third part indicates, the subject matter of dispute, the cause of counterclaim and the cause of counterclaim according to the types of lawsuits in general. Finally, the provions and consequences of counterclaim are explained in detail in the second section of the third part.
