Abstract (EN)

Capacity to have rights and capacity to act, which are basic concepts of civil law, affect validity of kinds of legal transactions. Therefore, in the disputes with foreign elements, determining applicable law to the mentioned concepts poses great importance. In this thesis, capacity to have rights and capacity to act will be examined firstly in the perspective of civil law. Later, conflict of laws rules that are used for determining the applicable law to capacity to have rights and capacity to act will be analysed. Within this scope, renvoi, transaction safety rule and intervention of public policy will be reviewed also. In the last chapter, jurisdiction of Turkish courts in the capacity related disputes, and recognition and enforcement of foreign court decisions on capacity related disputes will be examined.
