Abstract (EN)
This study, titled "The Reflection of Nationalism in Early Republican Period Legal Regulations" examines the interaction between nationalism and law in Early Republican Turkey. The aim of the study is to analyze how the ideology of nationalism influenced the legal regulations of the period and the outcomes of this interaction. The study is divided into three main sections. The first section addresses the origins and types of nationalism, comparing classical and modern theories of nationalism. While classical theories explore the historical and cultural contexts of nationalism, modern theories assess nationalism within the frameworks of social construction and primordialist approaches.The second section elaborates on the historical development and ideological structure of nationalism in Turkey. This section particularly focuses on the transition from the Ottoman Empire to the Republic and the evolving understanding of nationalism since the Second Constitutional Era. The third section examines the reflection of nationalist ideology in the legal regulations of the Early Republican period. In this context, legal reforms inherited from the Ottoman Empire, the Kanun-i Esasi, as well as legal regulations related to education, citizenship, and civil law during the Early Republican period, are analyzed. Additionally, the 1921 and 1924 Constitutions are evaluated from a nationalist perspective, emphasizing the impact of nationalism on constitutional activities. The reflection of nationalism in the legal regulations of the Early Republican period was a critical process that shaped the legal and social foundations of Turkey. The legal reforms implemented during this period were reflections of nationalist policies. In this regard, the study explores how the ideology of nationalism influenced the legal regulations of the Early Republican period, in what ways this impact manifested, and how these elements differed from the Ottoman legal system. By examining the influence of nationalist thought on the legal regulations of the Early Republican period, this study aims to contribute to a better understanding of Turkey's legal and social foundations.
