Abstract (EN)

Inheritance, one of the basic concepts of inheritance law refers to all of the transferable goods, rights, receivables and debts left behind by a deceased person. Inheritance is the real person who transfers his assets to his heirs as a result of the realization of the death phenomenon. The inheritance is poened with the realization of events that result in the death of a real person or the end of her/ his personality. As a result of the opening of the inheritance the rights and debts in the inheritance of the inheritance pass to the heirs. According to the principle of self – acquisition accepted in the acquisition of inheritance in Turkish inheritance law no statement of will will be sought fort he heir to acquire the estate. In addition, in accordance with the principle of universal succession, which is another principle accepted in Turkish inheritance law, the rights and debts in the estate will be transferred to the heirs as a whole with the death of the legator. As a result of these two principles, the heirs will have their rights and debts upon the death of the inheritor. The debts of the inheritance passed on to the heirs will be included in the estate and will constitute the debt of the estate. These debts are the debts that exist at the time of the decedent's death and the debts that arise after her/ his death. In addition to being jointly and severally liable for these debts as a result of the inheritance partnership arising from the law, they will also be liable with their personal assets. Keywords: Heir, Inheritor, Estate, Estate debts, Inheritance partnership, Jointly and Personally Liable.
