Abstract (EN)

This thesis analyses the legal basis and implementation of the principle under both national and international law by addressing the issue of "Convention on the Status of Refugees, the Constitutional Court and the The Principle of Non-Refoulement in the Framework of the Decisions of the European Court of Human Rights". The main purpose of the study is to analyse the application of the principle of non-refoulement in Turkey and to reveal the legal and humanitarian dimensions of this application in detail. The place and application of the principle of non-refoulement in Turkish law offers an important area of examination within the framework of the decisions of the Constitutional Court (AYM) and the European Court of Human Rights (ECHR). Turkey has reflected and implemented this principle in its domestic law in line with the international conventions to which it is a party. However, the practice of implementation and the approach of the courts to this principle have been the subject of criticism and debate from time to time. In conclusion, this thesis makes important contributions at both theoretical and practical levels by analysing in detail the legal basis of the principle of non-refoulement in Turkey, its implementation and the difficulties encountered.
