Invalidity of trademark due to realtive refusal

Trademark Marks which are used in the commercial field aim to introduce the go-ods and services they cover to the public and make a profit. The effect of trademark on the public ensures the users of the mark are recognized in commercial environment. The profit from commercial activities depend on this effect. In other words, people have rights based on the mark. Because of this, the rights of the individuals based on the mark must be protected. This protection aim to the interests of both users of the mark and those affectes by the mark. The causes of relative rejection are arranged to provide a solution to this situation. These reasons which based on existing rights of others on the mark, prevents the protection of interests of owner of the mark and the people affected by the mark. However, the fact that these reasons depend on individuals prevents them from being evaluated with objective criteria. It was even discussed under which title these reasons should be regulated for termination of the mark. The opinions of both ju-rists and legislators on this issue affect the interests of individuals related to the mark. Because of the importance of relative reasons for refusal on commercial life, it has been seen to be examined in this thesis. This thesis consists of three main chapters. In the first part, the meaning of inva-lidity in the mark and the reasons for this situation are explained. In the second chapter, the causes of relative rejection which are the main reasons of thesis are explained. In the third chapter, the relationship between causes of relative rejection and the invalidity case is examined.
