Abstract (EN)
Since its discovery, artificial intelligence (AI) has demonstrated rapid development, and AI-based solutions have begun to play a significant role in all aspects of human life. Artificial intelligence, which can be defined as computer programs aimed at mimicking human behaviour and performing activities carried out by humans through machines, has particularly started to create works in the field of art in recent years. This has led to confusion in terms of copyright, and questions regarding whether copyright can be established on these works and the potential consequences of the decisions made have transformed into a structure that occupies intellectual property experts and lawmakers. This study aims to examine the existence and limits of copyright protection on AI-generated works within the framework of the laws currently in practice in the European Union and Turkish Law. In this regard, firstly, the current copyright rules have been examined, the limits of human intervention in works produced by AI have been classified, and finally, efforts to determine the existence of copyright protection for AI-generated works in different situations have been presented. As it is still an unresolved dilemma, this study also includes the approaches of some countries that are not covered within the scope of the thesis and. The proposals presented have been scrutinized, considering the ethical discussions. Keywords: Artificial Intelligence, Intellectual Property Rights, Copyright, Work, Authorship.
