Rodovans agreement

This study is aimed at examining in detail the royalty contract, which is the subject of the lease of the mining operation license. Since there is not enough regulation in the royalty contract in the Mining Law No. 3213, the provisions of the Turkish Code of Obligations No. 6098 regarding the product lease contract are applied by analogy. While examining the royalty contract in the study, first of all, general information such as its definition, historical development, legal nature and elements are given. Afterwards, the rights and obligations of the parties (license holder and royalty) are explained. In the last part of the study, the termination of the royalty agreement and the disputes arising from the agreement are given to the competent court. In the study, which was completed in the form of a literature review, doctrinal views and the jurisprudence of the Supreme Court were mentioned when appropriate. The aim of the study is to contribute to the literature on this subject by discussing the royalty contract in detail and to help the application. Although the mining sector has an important place in Turkey, it has been understood from the examinations that more efforts are needed in terms of both legislation and academic work on the royalty contract. With this study, it is aimed to shed light on the implementation of the royalty contract.
