Protection of personal data in health law

The subject of this study is "Protection of Personal Data in Health Law". Personal health data includes all kinds of data related to the health and illness of the data owner. Special attention has been paid by the legislator to the protection of sensitive personal health data and detailed regulations have been made. The legal remedies that a person can apply in case of unlawful processing of personal health data are regulated in detail with both general and special provisions. For this reason, in our study, first of all, definitions of personal data and personal health data are made, and national and international regulations on the protection of personal data and the history of personal data protection law are included. Thus, the increasing importance of personal data and, in this context, personal health data over time has been underlined. Because, today's increasing technological possibilities have both increased the value of personal data and facilitated their illegal processing. Subsequently, the conditions for the processing of personal health data, the principles to be followed during processing, and the reasons for compliance with the law are explained. Finally, the legal ways that the person whose personal health data is processed unlawfully can apply has been examined.
