Abstract (EN)

In this study, special provisions of the moving article transportation agreement, which is arranged for the first time in the third section of the fourth book of Turkish Commercial Code numbered 6102, are examined and liabilities unique to this transportation are predicated and approached. The moving article transportation makes up the scope of our study not any article. Since the transportation of these articles requires precision, transportation of moving articles are subject to a set of special arrangements. When there is no special arrangement in the legislation, there is a general provisions implementation area for article transportation by land. In article 894 of the Code, clearly defined moving article is expressed as articles taken from a house, office or similar place and transported to a similar place. Rights and liabilities are the point in question for the parties in moving article transportation arising from the transportation agreement from the acceptance of the articles from a house, office and similar places until the delivery of them. Transportation of moving articles is a type of transportation where there is no obligation of transportation bill issuing for the sender and no liability of loading and unloading of the articles; and where the mover accepts the dismounting mounting of the furniture and loading and unloading of moving articles. In this transportation type, similar to other transportation types, the mover has the responsibility arising from loss, damage and delays and limiting this responsibility is subject to special conditions by also considering that the sender could be the consumer.
