Abstract (EN)

The thesis topic is comparative study related to the real estate pledge between Turkish and Iraqi Law. Iraq and Turkey have different legal systems. The Swiss legal system in Turkish law was accepted, and the French legal system (Applied in Egypt) was accepted in Iraqi law. There are also some differences in the real estate pledge in both legal systems. First of all, goodwill has been accepted as a principle according to Turkish law, but In Iraqi law, as in French law, it is not considered as a principle but as an individual element in certain matters. In addition, permanent construction and trees located on the real estate in Turkish law are in principle the property of the real estate (according to the necessary part principle). On the other hand, in Iraqi law, the construction and the trees located on the real estate are not a principle, but are presumption. Differences between the two legal systems lead to significant consequences.the goal of thıs thesıs‭ ‬ıs to found the dıfference between‭ ‬ıraq and turkey‭ ‬ın‭ ‬Pledge Of Real Estate.
