Medical professional liability compulsory insurance

As a liability insurance type "Medical Professional Liability Insurance" has been newly put in practice in our country. In pursuit of becoming widespread of this insurance type, with a new legislative regulation, it has been made obligatory to insure for doctors. Hereby, by this study, it is aimed to determine the present condition of "Medical Professional Liability Compulsory Insurance" in our country. So, in the first part of study, liability insurance has been explained by including basic concept. In the second part of the study, types of malpractice and medical liability have been set forth in terms of Turkish Code of Obligations. In the third part, medical professional liability compulsory insurance and its practice has been examined within the scope of comperative law and Turkish Law. For clarifying this examining, Turkish Code of Commerce and General Conditions of medical liability insurance has been used and deficiencies of these regulations has been set forth. According the result of the study, new legislative regulation regardind medical liability insurance is beneficial for doctors and hospitals. In order to increase the efficiency of this type of insurance, problems which arises from these present regulations has to be changed by new legal acts.
