Professional misconduct

This thesis aims firstly to explain the terms of the public officer, the officer, the public service, the public administration and the public action by the reason of the fact that the "Professional Misconduct" can be committed by the public officers according to the Turkish Criminal Law numbered 5237, Especially the term of the public officer has been studied in detail with reference to the Constituonal Law, Administrative Law and Criminal Law. The regulations of the Turkish Criminal Code numbered 5237 and the aspect of the comparative law, the draft of Criminal Law and the bills have been examined. The differences of the Professional Misconduct between the similar crimes, the elements of the crime and the personal unjust treatment stated in the article and the public damage have been studied. And particularly the situation of the unjustifiable benefit provided to the others has been discussed whether it is an objective punish clause or a consequence within the scope of material element. Endly, the juristical procedure of the public officer has been examined.
