Abstract (EN)
The transfer process of commercial enterprises is a complex and sensitive issue in terms of the status of debts and the legal protection of creditors. This study presents a comprehensive analysis of the existing legal framework to protect the status and rights of creditors during the transfer of commercial enterprises. The study covers the concept of commercial enterprises, the transfer process, the status of debts, and the legal protection of creditors. Supreme Court decisions demonstrate that caution is exercised in protecting the rights of creditors and preventing individuals and companies from engaging in fraudulent activities to avoid paying their debts. This research focuses on the legal framework and the rights of creditors in commercial enterprise transfer transactions and presents an analysis of the current situation in the light of regulations aimed at ensuring that the interests of all stakeholders are sufficiently protected and transparency, fairness, and efficiency are ensured.
