Abstract (EN)

Sale contract is a contract type that encountered in social life frequently. Especially, in globalizing world with the technological development, the trading relationship between the seller and the buyer has great importance, not only within the borders of the country, also in the international arena. Indeed, Azerbaijan and Turkey called as "one nation, two states? are in wide-ranging cooperation in the commercial area as well as in all other areas. Therefore, to know legal regulations of these two friendly and brotherly country is important for both Turk and Azerbaijani seller and buyer who will invest and carry on a business. In this context, in Turkish and Azerbaijani Law in commercial sales, in case of delivery of defective goods to buyer, optional rights of buyer and to use these rights obligations of buyer were examined.During our study when required, it is attempted to bring to a conclusion for the controversial points by giving the opinions of the authors in doctrine, for this purpose Court of Appeals decisions that form the application are included.In the introduction part of the thesis, the presentation, the importance and the restriction of the thesis subject are emphasized.In the first section, the arrangement of the subject in Turkish and Azerbaijani Law and commercial sale concepts are discussed.In the second part of the study, in Turkish and Azerbaijani Law , the relations between, warranty debt concept, the circumstances of responsibility of warranty against defects, optional rights arising from warranty against defects and general provisions of obligations are emphasized.In the third section, in Turkish and Azerbaijani Law, in case of warranty debt, the obligations and burdens of buyer were examined.In the fourth part of our study, in Turkish and Azerbaijani Law , in case of warranty debt the optional rights of the buyer were examined.
