Abstract (EN)
The subject of our study is release agreement in Turkish Code of Obligations. The release agreement which was not regulated by the Turkish Code of Obligations No. 818, appeared in practice because of freedom of contract. However the lack of legal regulation caused disagreements, especially regarding the form. This deficiency has been corrected with Turkish Code of Obligations No. 6098 and the release agreement has been included in the law. The release agreement is the termination of the dept by the creditor and the debtor without being subject to any form. The release agreement is bilateral legal act and requires the consent of both the creditor and the debtor. With the release agreement, the dept relationship is not terminated only narrow sense of the dept is terminated. Parties wishing to terminate the dept relationship should conclude a rescission agreement, not a release agreement.
