Abstract (EN)

Extradition, which is one of the cogs of the international criminal law mechanism, is the oldest and most important international legal assistance institution. A systematic examination of this institution's theoretical foundations is required to solve discrete problems encountered or likely to be encountered during the extradition process. Therefore, beyond considering extradition as a routine procedure between states, there is a need to investigate the historical and intellectual foundations of extradition law, as well as to scrutinise the concepts and issues related to extradition law in relation to their chronological and intellectual backgrounds. The study's goal is to address this need. The research concentrated on the theory of extradition law. The practise of extradition has not gone unnoticed, so the practical results of theoretical discussions have been analysed. After a thorough examination of the fundamental concepts and sources of extradition law, the conditions under which an extradition request can be accepted and the circumstances under which its acceptance or rejection is mandatory have been investigated. In this regard, each concept and institution examined in this study has been thoroughly examined in terms of terminology as well as intellectual and chronological history. In the light of this examination, the practical consequences of the rules and principles of extradition law were questioned. Each step of the extradition procedure was also extensively discussed in the study, particularly the rules on the admissibility trial of an extradition request. Suggestions on extradition law were also presented in the context of de lege ferenda.
