The crime of extortion in Turkish Criminal Law

The crime of extortion is stipulated in Turkish Criminal Code (No. 5237) under the section of Crimes Against Liberty. This crime is a special type of crime of threat in which the perpetrator commits the crime to profit materially. In our thesis, we have explained the difference of the word extortion in daily language and the way it is used in the TCC, and also delved into the differences of this crime, which is closely related to one's liberty, from other similar crimes. We have also explained the differences regarding this crime in the now obsolate TCC (No. 765) and the current TCC (No. 5237) and also other appearances of this crime in comparative law. We have delved into whether this is a crime of endangerment or crime of harm, and provided some examples of this crime from the Court of Appeals' decisions. We explained the elements of this crime, and particularly the material element of result. Finally, we have mentioned what could make this action lawful, and the procedural aspects of prosecution and execution.
