Abstract (EN)
Banks face various challenges during their operations. The most significant among these are the factors that could disrupt banking stability, which guides economic and development goals. This is because banking stability leads to economic growth, competition, and increased banking efficiency and effectiveness. It is widely known that bank deposits must be repaid to the depositors, who are the savers. Generally, the integrity of the monetary system relies on the security of the instruments represented by money and deposits. Therefore, the emergence of a threat to deposits poses a direct threat to the banking system. Consequently, the existence of an institution or organization that works to secure depositors' funds and ensures the integrity and stability of the banking system has been deemed necessary. The protection of bank investors and regulations regarding public disclosure may differ according to the laws and regulations of Turkey and Palestine. In this context, the subject of our study is to examine the systems that protect depositors' funds and rights, as well as the rights of all types of bank investors, against processes that disrupt banks' financial conditions. This thesis will comparatively analyze the legal regulations and laws in Turkish and Palestinian jurisdictions that are responsible for protecting investors, and will assess the effectiveness of the institutions and organizations entrusted with this duty. Additionally, the study aims to identify the shortcomings in these countries' investor-related contexts and provide recommendations. Furthermore, all types of primary sources such as systematic works, monographs, reports, journals, newspapers, interviews, articles, theses, etc., will be reviewed and added to the literature through this research. All gathered information in the research will be filtered through a mental process, classified, interpreted according to the theoretical framework, and evaluated.
